TERMS AND CONDITIONS OF POSTING : PLEASE READ THE INFORMATION BEFORE SUBMITTING A POST:

1. You are requesting that we post your property details on this web site with all responses directed to L&M Property Marketing for an Administration Fee of AUD$110 for a period of six months from the end of the month that the posting is uploaded on this web site. (You are welcome to request a further 6 month renewal at the end of the posting period on payment of further posting fees). In making this request by signifying 'Yes' and submitting or sending the above form, you are signifying that you are the registered legal owner or legally authorised to sell the property (referred to as the Seller) and you are agreeing to these Terms and Conditions and the terms of our Privacy and Disclaimer available on this web site.

2. Should there be interest in your posting, we will contact the seller, using the details you have provided. As soon as possible, we will formalise a Sales Agency Agreement for the sale (or trade) of your property (Copy of Agreement is available on request) and ask you for a copy of the Contract for Sale (usually prepared by your Solicitor or Conveyancer). Only then can L&M Property Marketing formally work to conclude a sale (or trade). Should a sale be completed, commission will be payable to L&M Property Marketing (Commission Schedule available on request) and the Administation Fee paid will be refunded in full on settlement of contracts.

3. Postings will be positioned with the next expiring or oldest posting at the top of the first page. In each posting, we will post a small version of the image received from you, along with details of what you will trade into, a short and long description and the valuation or price. There is also a dedicated page for further details. The seller's contact details and the sale property address will not be posted. There is one posting permitted per property so if you have more than one property to offer, you need to complete an individual posting and pay the Administration Fee for each property. Should you have 10 or more properties to post, please discuss a commercial posting arrangement with us.

4. The posting process: After completing and submitting the form above, we ask that you please send one good image that illustrates the property to; info@property-online.com.au using the words you have used in the short description (Part 6 of the form) in the subject line. You can send up to two more images for use on the dedicated page. While common sense will be used, the ideal image size is: 300 px wide X 200 px high X 72 dpi. Raw images or large images may not be received by us, if we do not receive a useable image, the posting will contain a 'filler' image. Sellers warrant that all images provided are free of rights and not subject to any copyright and further, sellers agree to absolve L&M Property Marketing in full from all liability resulting from use of the images supplied.

Before a posting is uploaded, the property details you provide must be approved by L&M Property Marketing. After approval we will forward a Tax Invoice for the Administration Fee. After payment is received we will upload your posting to the web site with all responses directed to L&M Property Marketing. When we receive a response, we will contact you (in accordance with clause 2 above).

All postings are at our discretion. We reserve the right to not post, to make amendments, to create categories of postings and or to remove any posting deemed not to be acceptable for any reason at any time. Any refund will be limited to complete unused months of the six month period. In the event a posting is removed for reasons of; inappropriate, unprofessional or disreputable conduct, inaccurate images or information, faulse discriptions, wrong contact details, misleading information, the Administration Fee is forfited in total and no refund is due.

6. L&M Property Marketing, its subsidiaries, associate Companies, Agents, Advisers, Employees, Shareholders and or Directors accept no responsibility or liability whatsoever for any loss, damage or action taken arising out of or by virtue of the information on this web site. No Warrantees are given expressly or implied, in part or whole as to the correctness and accuracy of information or images posted on this web site. All parties are required to conduct their own research and seek independent advice before encurring cost, making any decision or considering to purchase any property.

7. It is a condition of posting that Sellers agree to only provide accurate images, true descriptions and correct information in submissions. It is therefore a condition that Sellers agree only to provide accurate images, true descriptions and correct information in your submissions and act in an appropreate, professional and reputable way at all times. Submissions, where we have reason to believe or have evidence that the information is not correct ie: wrong contact details, misleading or inaccurate images or information, inappropriate, unprofessional or disreputable conduct or faulse or misleading descriptions or for other not specified reasons, will not be posted or if posted, may be removed after posting. In the event a posting is removed after posting, the Administration Fee is forfited in total by the Seller and no refund is due.
